服务条款
本服务条款适用于 KiteDance 网站、桌面应用、API 服务、模型调用、计费和在线收款功能。使用 KiteDance 即表示你同意本条款。
KiteDance 由北京集智创新科技有限公司提供。若你代表公司或团队使用服务，你确认你有权代表该组织接受本条款。
1. 服务内容
KiteDance 提供 AI 编程协作、项目管理、工作流管理、任务分支、Git worktree 编排、模型调用路由、费用记录和相关辅助功能。
我们的大模型 Agent Server 使用的是标准的 Codex App Server，KiteDance 仅仅是一个大模型封装调度。
2. 账户责任
你需要提供真实、准确、可联系的信息，并对账户、登录凭证、团队成员权限和在账户下发生的活动负责。发现未授权访问时，应立即联系我们。
3. 数据和聊天记录
我们不会留存任何用户的聊天记录，数据会和后端的合规大模型供应商（如 OpenRouter）直接交互。
你保留对你提交的代码、项目内容和任务资料的权利。你授予 KiteDance 在提供服务所必需范围内处理这些内容的权限，包括调用模型供应商、生成任务结果、同步状态和展示使用记录。
4. 密码和安全
我们不会明文存储任何密码信息，所有信息都是加密存储在 Cloudflare 上，我们没有自建机房和数据库。
你不得绕过安全机制、探测非授权系统、滥用接口、上传恶意代码、侵犯他人权利，或将服务用于违法、有害、欺诈、骚扰、侵权或规避监管的用途。
5. 可接受使用政策
你不得使用 KiteDance 生成、请求、传播或协助生成 NSFW、色情、性剥削、儿童性虐待、暴力极端主义、自残、仇恨、骚扰、欺诈、恶意软件、网络攻击、违法交易或其他有害内容。
你也不得使用服务规避平台安全策略、诱导模型输出受限内容，或协助他人实施上述行为。我们可以移除相关内容、限制请求、暂停账户或依法配合监管处理。
6. 模型供应商与输出
KiteDance 可能通过 OpenRouter、Cloudflare 或其他合规模型供应商转发请求。模型输出可能不准确、不完整或不适合直接用于生产环境。你应自行审查、测试和确认代码及建议。
7. 付款、充值与费用
部分功能按模型调用、服务费或充值余额计费。显示价格可能因模型、通道、币种、税费和供应商价格变化而调整。除法律要求或我们明确同意外，已使用的服务费用不予退还。
8. 可用性和变更
我们会合理维护服务可用性，但不保证服务不间断、无错误或始终兼容所有第三方模型、代码仓库、网络环境和操作系统。我们可以为安全、合规、运营或产品原因更新、暂停或终止部分功能。
9. 知识产权
KiteDance 的软件、界面、品牌、文档和服务设计归 KiteDance 或其许可方所有。除法律允许或我们书面授权外，你不得复制、反向工程、出售或再许可 KiteDance 服务。
10. 责任限制
在法律允许范围内，KiteDance 不对间接损失、利润损失、数据丢失、业务中断、第三方服务问题或模型输出导致的后果承担责任。我们的累计责任以你在争议发生前 3 个月向 KiteDance 支付的服务费为上限。
11. 终止
如果你违反本条款、存在安全风险、拖欠费用或法律要求我们采取行动，我们可以限制、暂停或终止你的账户或服务访问。你也可以停止使用服务并联系我们处理账户相关请求。
12. 适用法律与争议
本条款受中华人民共和国法律管辖。因本条款或 KiteDance 服务产生的争议，双方应先友好协商；协商不成的，提交北京有管辖权的人民法院解决。

Terms of Service
These Terms of Service apply to the KiteDance website, desktop app, API services, model calls, billing, and online payment features. By using KiteDance, you agree to these Terms.
KiteDance is provided by Beijing Jizhi Innovation Technology Co., Ltd. If you use the service on behalf of a company or team, you confirm that you are authorized to accept these Terms for that organization.
1. Service description
KiteDance provides AI coding collaboration, project management, workflow management, task branches, Git worktree orchestration, model routing, usage records, and related support features.
Our large model Agent Server uses the standard Codex App Server. KiteDance is only a wrapper and orchestration layer for large models.
2. Account responsibilities
You must provide accurate and reachable information and are responsible for your account, login credentials, team permissions, and activity under your account. Contact us promptly if you discover unauthorized access.
3. Data and chat records
We do not retain any user chat records. Data interacts directly with compliant backend large model providers, such as OpenRouter.
You retain rights to the code, project content, and task materials you submit. You grant KiteDance permission to process that content as needed to provide the service, including calling model providers, generating task results, syncing state, and displaying usage records.
4. Passwords and security
We do not store passwords in plaintext. All information is encrypted and stored on Cloudflare. We do not operate our own data center or database.
You must not bypass security controls, probe unauthorized systems, abuse APIs, upload malicious code, infringe others' rights, or use the service for unlawful, harmful, fraudulent, harassing, infringing, or regulatory-evasion purposes.
5. Acceptable Use Policy
You must not use KiteDance to generate, request, distribute, or assist in generating NSFW, pornographic, sexual exploitation, child sexual abuse, violent extremist, self-harm, hateful, harassing, fraudulent, malware, cyberattack, illegal transaction, or other harmful content.
You must not use the service to evade platform safety policies, induce models to output restricted content, or help others engage in these activities. We may remove related content, restrict requests, suspend accounts, or cooperate with regulators as required by law.
6. Model providers and outputs
KiteDance may route requests through OpenRouter, Cloudflare, or other compliant model providers. Model outputs may be inaccurate, incomplete, or unsuitable for direct production use. You are responsible for reviewing, testing, and validating code and suggestions.
7. Payments, recharge, and fees
Some features are charged based on model usage, service fees, or prepaid balance. Displayed prices may change based on model, route, currency, taxes, and provider pricing. Except where required by law or expressly agreed by us, fees for used services are non-refundable.
8. Availability and changes
We will reasonably maintain service availability, but we do not guarantee uninterrupted, error-free, or universal compatibility with all third-party models, code repositories, networks, or operating systems. We may update, suspend, or discontinue features for security, compliance, operational, or product reasons.
9. Intellectual property
KiteDance software, interfaces, branding, documentation, and service design are owned by KiteDance or its licensors. Except as permitted by law or authorized by us in writing, you may not copy, reverse engineer, sell, or sublicense the KiteDance service.
10. Limitation of liability
To the extent permitted by law, KiteDance is not liable for indirect damages, lost profits, data loss, business interruption, third-party service issues, or consequences caused by model outputs. Our aggregate liability is limited to the service fees you paid to KiteDance in the three months before the dispute.
11. Termination
We may restrict, suspend, or terminate your account or service access if you violate these Terms, create security risks, fail to pay fees, or if law requires us to act. You may stop using the service and contact us for account-related requests.
12. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China. Disputes arising from these Terms or the KiteDance service should first be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to a competent court in Beijing.
